UPDATED: Supreme Court rules indoor dining ban was legal after NM restaurants learn they can reopen at 25%

Gov. Michelle Lujan Grisham’s administration did not act on impulse or with disregard when it reimplemented a temporary prohibition on indoor dining in July in an effort to curb an increase of Covid-19 infections, the New Mexico Supreme Court ruled on Wednesday.

Only actions that are in disregard of the facts and circumstances can be deemed arbitrary and capricious, said New Mexico Supreme Court Justice Judith K. Nakamura, who delivered the unanimous opinion.
